Website Acceptable Use Policy

This acceptable use policy (together with the separately posted Terms of Use, Privacy Policy and Website Cookies Policy) tells you the terms on which you may make use of our website www.joulesusa.com and any other website on which this policy is posted or expressly referenced ("Joules Sites"), whether as a guest or a registered user. Your use of the Joules Sites means that you accept, and agree to abide by, this acceptable use policy.

      You may only use the Joules Sites for lawful purposes in accordance with this acceptable use policy and the Terms of Use. You may not use the Joules Sites:

    1. In any way that breaches any applicable federal, state, local, or international law or regulation, including, without limitation, any laws regarding the export of data or software to and from the United States or other countries.

    5. To engage in conduct that restricts or inhibits anyone’s use or enjoyment of the Joules Sites, or which, as determined by us, may harm Joules or users of the Joules Sites or expose them to liability.
    6. To send, knowingly receive, upload, download, use or re-use any material which does not comply with our Content Standards.
    7. To transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam).
    8. To knowingly use any device or software, transmit any data, or send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware or the proper functioning of the Joules Sites.

    13. Not to attempt to gain unauthorized access to, interfere with, damage or disrupt any parts of the Joules Sites, the server on which the Joules Sites are stored, or any servier, computer or database connected to the Joules Sites.
    14. Not to attack the Joules Sites via a denial-of-service attack or a distributed denial-of-service attack.
    15. Not to otherwise interfere with the proper functioning of the Joules Sites.

      Where we do provide any interactive service, we will provide clear information to you about the kind of service offered, if it is moderated and what form of moderation is used.

      These content standards apply to any and all material which you contribute to any of the Joules Sites (“User Content”), and to any interactive services associated with it.

      Any User Content you post to the Joules Sites will be considered non-confidential and non-proprietary. By providing any User Content on the Joules Sites, you grant us and our affiliates and each of their respective licensees, successors and assigns the right to use, reproduce, modify, perform, display, distribute and otherwise disclose to third parties any such material.

      You represent and warrant that User Content you post to the Joules Sites complies with the this acceptable use policy and the Terms of Use and that you own or control all rights in and to your User Content and have the right to grant the license granted above to us and our affiliates and each of their respective licensees, successors and assigns.

      You understand and acknowledge that you are responsible for any User Content you submit or contribute, and you, not Joules, have full responsibility for the content or accuracy of any User Content posted by your or any other user of the Joules Sites. We are not responsible, or liable to any third-party, for the content or accuracy of any User Content posted by you or any other user of the Joules Sites.

      You must comply with the spirit of the following standards. The standards apply to each part of any User Content as well as to its whole.

      User Content must:

    1. Be accurate (where they state facts).
    2. Be genuinely held (where they state opinions).
    3. Comply with applicable law in the US and in any country from which they are posted.

    12. Be made in breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidence.
    13. Promote any illegal activity.
    14. Be threatening, abuse or invade another’s privacy, or cause annoyance, inconvenience or needless anxiety.
    15. Be likely to harass, upset, embarrass, alarm or annoy any other person.
    16. Be used to impersonate any person, or to misrepresent your identity or affiliation with any person.
    17. Give the impression that it emanates from us or is endorsed by us if this is not the case.
    18. Advocate, promote or assist any unlawful act such as (by way of example only) copyright infringement or computer misuse.
    19. Involve commercial activities or sales, such as contests, sweepstakes and other sales promotions, barter or advertising.

      We will determine, in our discretion, whether there has been a breach of this acceptable use policy through your use of the Joules Sites. When a breach of this policy has occurred, we may take such action as we deem appropriate.

      Failure to comply with this acceptable use policy constitutes a material breach of our Website Terms of Use upon which you are permitted to use the Joules Sites and may result in our taking all or any of the following actions. We have the right to:

    1. Immediate, temporary or permanent withdrawal of your right to use the Joules Sites.
    2. Immediate, temporary or permanent removal of any User Content uploaded by you to the Joules Sites.
    3. Issue of a warning to you.
    4. Legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach.
    5. Further legal action against you.

    7. Disclosure of information about you to law enforcement authorities as we reasonably feel is necessary.

      8. We exclude liability for any action we may take in response to a breach of this acceptable use policy. The responses described in this policy are not limited, and we may additionally take any other action we reasonably deem appropriate. Without limiting the foregoing, we have the right to fully cooperate with any law enforcement authorities or court order requesting or directing us to disclose the identity or other information of anyone posting any materials on or through the Joules Sites. You waive and hold harmless Joules and its affiliates and licensees from any claims resulting from any action taken by, during or as a result of its investigations and from any actions taken as a consequence of investigations by either such parties or law enforcement authorities.

      However, we do not undertake to review material before it is posted on the Joules Sites. We cannot ensure prompt removal of objectionable material after it has been poste. Accordingly, we assume no liability for any action or inaction regarding transmissions, communication or content provided by any user or third party. We have no liability or responsibility to anyone for performance or non-performance of the activities described in the section.

      Please try and focus on the product details when writing product reviews and avoid any comments that might be offensive, relate to pricing or discounts, postage, customer service issues or refer to competitors.

      We reserve the right not to post your review if it contains any of the following types of content or violates any other guidelines:

    1. Obscenities, discriminatory language or other language not suitable for a public forum.
    2. Advertisements, “spam” content, or references to other products, offers or websites.
    3. Email addresses, URLs, phone numbers, physical addresses or other forms of contact information.
    4. Critical or spiteful comments about other reviews posted on the Joules Sites or about their authors.

      If you believe that any User Content violates your copyright, please see our Terms of Use for instructions on sending us a notice of copyright infringement. It is our policy to terminate the accounts of repeat infringers.

      We may amend this acceptable use policy at any time by amending this page. The date at the top of this page will be amended each time this policy is updated. Please check this page from time to time as any changes we make will be binding on you.
